Edapho offers ecological testing packages, consulting visits, retainers, restoration services, and physical products including fertilizers, seeds, and other goods. Some services require user registration and access to private data reports.

To access certain features, you may need to create an account. You are responsible for safeguarding your login credentials and for all activities under your account. You agree to provide accurate and complete information. We reserve the right to suspend or terminate your access at our sole discretion.

All payments for services or products must be made through our designated checkout system. By submitting payment information, you authorize us to charge the applicable amount. Prices are subject to change without notice. Sales are final unless expressly stated otherwise in a specific service agreement. Shipping and tax charges, if applicable, will be added at checkout.

All reports, analyses, figures, maps, and recommendations provided through this Site are proprietary to Edapho. By accessing your reports or ordering services, you are granted a non-exclusive, non-transferable license to use the data solely for planning and implementation on the property assessed. You may not copy, modify, distribute, or use any report, data, or content for publication, research, resale, or commercial application without prior written consent.

You are solely responsible for ensuring that any contractors, consultants, or third parties granted access to reports or services through your account are bound to the same limitations stated herein. Any unauthorized retention, distribution, or derivative use of Edapho data by such parties will be considered a breach of these Terms by you.

  • Use data or content for unrelated projects, marketing, or publications
  • Share reports with third parties outside your implementation team
  • Allow consultants or contractors to reuse, retain, or adapt data for other clients
  • Resell or sublicense any information from this Site
  • Interfere with Site security, access controls, or user accounts
  • Attempt to reverse engineer any tools, maps, or analytics

Products such as seeds and fertilizers are offered as-is, subject to availability. Edapho does not guarantee outcomes resulting from use of any product. It is your responsibility to confirm that products are appropriate for your local conditions and regulations.

This Site uses third-party integrations, mapping tools, analytics platforms, and ecommerce processors. We do not control or endorse third-party services and are not liable for any actions, failures, or policies of such providers. Your use of third-party features is subject to their terms of service and privacy policies.

All content, logos, trademarks, service names, and underlying technologies on this Site are owned or licensed by Edapho. No content may be copied, reproduced, or used for commercial purposes without our prior written consent.

Your reports may include sensitive ecological or property-specific data. Sharing, publishing, or disclosing any report or data publicly, in any form, without our written consent is strictly prohibited. All reports are intended for private use only.

By accessing or using any part of this Site, and by checking the box or proceeding with a purchase, you acknowledge and agree to be bound by these Terms. A visible clickwrap confirming agreement to these Terms is presented at the bottom of every page. Continued use of the Site constitutes acceptance.

If a dispute arises, you agree to first attempt to resolve it through confidential mediation in Washington County, Texas. If mediation fails or is not initiated within 30 days of notice, either party may pursue legal remedies in the state or federal courts of Washington County, Texas. Nothing in this section limits the right to seek equitable relief for breach of confidentiality, IP misuse, or violations of license restrictions.

To the maximum extent permitted by law, Edapho is not liable for any indirect, incidental, or consequential damages arising from the use of this Site, including reliance on data, delays, lost profits, or third-party services. Total liability shall not exceed the amount paid by you for the relevant service or product.

We reserve the right to suspend or terminate your account or access to the Site at any time if you breach these Terms or misuse the Site. Upon termination of your account, you must cease all further use of reports, data, or proprietary content, and delete or securely destroy any downloaded or retained copies. Continued use of any Edapho data, tools, or methodology after termination is a violation of this Agreement and may result in legal action.

For the purposes of this Agreement, a breach includes, but is not limited to: unauthorized sharing or reuse of proprietary data; violation of the data license terms; use of the Site or its content for reverse engineering, scraping, or competing services; misrepresentation of identity or intent during purchase or consulting processes; or violation of the Code of Conduct or Community Standards.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. All disputes shall be subject to the exclusive jurisdiction of courts located in Washington County, Texas.

We may update or modify these Terms at any time by posting a revised version on this page. Your continued use of the Site after changes are posted constitutes your acceptance of those changes.

Edapho respects the intellectual property rights of others and expects users to do the same. If you believe that any content on our Site infringes upon your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown request by providing the following information:
